This website is owned and operated by Ian R. Pearsall. These Terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers visitors the opportunity to purchase Original Works of Art; Reproductions of said Works of Art by the Owner named. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.

In order to use our website and/or receive our services, you must be at least Eighteen years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.

When buying an item, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.

The prices I charge for using our services / for our products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. You, the Customer are responsible for Import/Sales Taxes incurred upon a product purchase once the purchase is registered (by notification of the couriers tracking log) as being in the Country of Purchase.

  Only damaged Product can be returned. All Products are checked prior to despatch. Courier Damaged Products ONLY are eligible for return. Product and Packing must be photographed and included in any Corresponding correlating to the Returns Process.
Simply return it with its included accessories and packaging along with the original receipt (or gift receipt) within 14 days of the date you receive the product. Cordial Communication is essential and I will exchange it or offer a refund based upon the original payment method.
Return Policy.

1. Store credit for the full purchase price, or
2. A refund to your original payment method less a 20% processing fee calculated off the total purchase amount.

It is assumed that you the Customer are purchasing An Original Work of Art, and that the marks of it's creation come into effect as being different from a visual image of the Work and that it is purchased in the full knowledge of that understanding. 

You recognize and agree that by Purchasing Original Works; any content (including, but not limited to designs, images, animations, videos, audio files, fonts, logos, illustrations, compositions, artworks, interfaces, text and literary works) through any means to the website, that I, Ian R. Pearsall own all the relevant rights and Images must not be reproduced for further sale.

Your name and address WILL NOT be used at any time for any promotional messages and materials from us, by mail, email or any other contact form you may provide us with (including your phone number for calls or text messages). Your name and address will only exist on the original order and subsequent receipt for taxation purposes and will not exist beyond my legal requirement to retain said information.

These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of The United Kingdom and Northern Ireland, without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in Stoke-on-Trent. The application of the United Nations Convention of Contracts for the International Sale of Goods is hereby expressly excluded.

Specific Return & Refunds Policy

For buyers who wish to pay with a credit card and DO NOT wish to sign up for a PayPal account: At checkout, after you submit your order click the “Pay Now” button. Click on the PayPal icon and you will be redirected to PayPal, click the “I do not have a PayPal account”. Scroll Down and you will see the option to pay with a Credit or Debit Card WITHOUT having to sign up for a PayPal account. Follow the instructions (you will not be required to create an account to complete a purchase).
Shipping

I use registered mail for shipping and purchase a barcode which will provide basic tracking as well as online viewable delivery confirmation. This is a very safe method for international shipping at a reasonable charge. Most national shippers provide real time tracking at their websites once they accept the mail piece.

Where stock is held I aim to ship within two business days of cleared payment. Product that is made to order I aim to complete within 1 week.  I ship using door to door services.  US, Canada & Europe  I use 48hr delivery; tracked and signed.  The actual  speed of shipping depends entirely couriers system dependant  on the traffic and customs work at the receiving end.. Seasonal conditions  also apply.

I combine shipping whenever I can and most of my items have very low "with another item" shipping prices .

The post office uses calculated shipping based only on weight and does not have flat rates for mail. Also, shapes of the items determine the size and weight of the packing material and boxes.

Very large or heavy items might not have lower "with another item" prices set. In case you buy several such items and the actual shipping price exceeds what you have paid, I will reimburse you the relevant amount with a Paypal refund.

Generally, post offices HOLD registered mail if their first delivery attempt is a failure. Then you might need to either schedule redelivery by phone and through their webpage or go to the post office to PICK UP the mail personally by SIGNING.

Registered mail is very safe but it is not fast. EXPEDITED SHIPPING IS AVAILABLE. This is a fast and efficient service of the national carrier with a delivery estimate of 2-5 days. Please contact me for quotes. Its prices are high but still costs considerably less than what companies like DHL and FEDEX would charge. This service offers detailed real-time tracking and signature confirmation upon delivery.


Whatever shipping method I use, I buy all the available security options and pack my items safely. I DO ACCEPT RETURNS IF THE ITEM FAILS TO MATCH THE DESCRIPTION OR THE ITEM IS DAMAGED IN THE POST UPON OPENING - THIS MUST BE REPORTED IMMEDIATELY AND WHERE POSSIBLE PLEASE PHOTOGRAPH SO I CAN OPEN A CASE AGAINST THE COURIER. Buyer is to return the item in original condition (buyer pays for return shipping) for the full refund of purchase plus original payment for shipping. I would issue the refund via Paypal as soon as I receive the item. I recommend purchasing delivery confirmation for return shipping.
